CONDITIONS OF SALE
Commercial relations between d-kola and customers are governed exclusively by the following general conditions of sale, excluding any other agreement, unless agreed in writing; also placing an order online implies full acceptance of the following conditions.
d-kola is not responsible for any damage or loss, direct and / or indirect, deriving from the sale of goods and services offered in the catalog published on the website www.d-kola.com, even for delayed and / or non-delivery of the product, neither for the correspondence of the goods to the specifications published on the site, nor for any other fact not directly attributable to d-kola.
3. Technical information
The technical information included in the website www.d-kola.com is obtained from the information published by the manufacturers of the goods included in our catalog. d-kola, therefore, reserves the right to modify / adapt the technical and dimensional information of the products in the catalog, based on what will be communicated by the producers, even without any prior notice.
Orders are accepted only and exclusively in writing, or by fax, or via the internet (online). The customer who sends the order via the internet will receive, at the end of the procedure, a communication confirming the order has been placed, or by e-mail (email), indicating the relative order number.
5. Prices and currency
All prices posted on the site are inclusive of VAT (unless otherwise specified). If the discount is not specified, the net sales price to the customer will be indicated. Prices and discounts can be changed at any time, without notice. Orders are invoiced in Euros and reflect the prices in Euros published on our website. The amount that will be charged to your credit card or your Paypal account may vary as it is based on floating exchange rates and bank charges. d-kola invites customers to contact their banking institution to request detailed information on exchange rates and bank charges relating to their transaction.
6. Product availability
In the product catalog published on the website www.d-kola.com, in the availability area, the quantities of product in the d-kola warehouse are highlighted. Since access and the possibility of placing orders online modify product availability in real time, d-kola does not guarantee the certainty of assignment of the ordered goods, until the order itself is visible in the Your orders area with a appropriate state.
7. Shipping and delivery
Unless otherwise agreed, shipments will be made by carriers defined by d-kola or its delegate. In this case, and only when the shipping cost is charged, the goods travel at the risk of d-kola. In case of theft / loss d-kola undertakes to send a new product and, if the same should be unavailable and / or out of stock, it will propose a different product, but with equivalent characteristics, with the right for the customer not to accept this new product. and request the issuance of a credit note relating to the product itself. In the hypothesis that the transporter is instructed, in any capacity by the customer, d-kola will not be responsible for the loss and / or damage of the product from the moment of delivery of the goods to the carrier at its warehouses. The delivery time, purely indicative, is published in the appropriate table on the website when placing the order; the same may undergo variations due to force majeure or due to traffic conditions and road conditions in general or by act of the Authority. Delivery, unless otherwise agreed in writing between the parties, will take place on the ground floor and during office hours: from 09.00 to 13.00; from 2.00 pm to 6.00 pm, every day, except holidays, from Monday to Friday. 8. Traceability of the shipment
When the order is shipped, d-kola sends its customers an e-mail containing the tracking number provided by the Courier. Customers can follow the status of their shipment using the link in the e-mail, which redirects to the Courier's website.
9. Risk and ownership
The goods are shipped carriage paid, insured with a charge on the invoice; in the event that the goods were shipped carriage forward, upon the customer's indication, the risk is to be considered borne by the customer from the delivery of the goods to the carrier from its warehouses. Upon delivery of the goods, the customer must check the integrity of the packages and the quantitative and qualitative correspondence with what is indicated in the accompanying document (DDT). In case of discrepancy, the same must be reported on the same accompanying document and confirmed, within fourteen days by fax or registered letter with return receipt, to d-kola to the sales representative. Even if the packaging is intact, the goods must be checked within fourteen days of receipt. Any hidden anomalies must be reported in writing by fax or registered letter with return receipt. Any report beyond the aforementioned terms will not be taken into consideration. For each declaration, the customer assumes full responsibility for what is declared.
10. Articles and images online
d-kola declines all responsibility for the possibility that, due to a particular configuration of the computer used by the customer or its malfunction, the colors of the products displayed on the site may be slightly different from the original ones. The images contained on the website www.d-kola.com are the property of d-kola. Any use of such images, not authorized by written consent from d-kola, will be prosecuted according to the law. It is possible that the designers decide to make changes to the garments in the production phase or even decide not to produce them. The images of the products on the site www.d-kola.com are purely indicative and may therefore not be fully representative of the characteristics of the product, differing in colors, dimensions or accessories.
11. Personalized Items and Products
By placing the order, the Customer assumes all responsibility for the type of customization, positioning, size, spelling accuracy, color accuracy and layout of the customizations. In no case d-kola can be held responsible for any errors in copying, transcription or reconstruction of logos or designs, as the Customer by sending the purchase order and / or where required by accepting the graphic drafts received or confirming the production. . d-kola is not responsible for the legitimacy of images and content of the material provided by the customer. For customized products with embroidery or where expressly provided for by the type of item or customization; the Customer must also expressly accept the "Graphic Draft" relating to personalization. For products in which the sending and acceptance of the graphic draft is expected, the Customer may only request changes that involve the graphics initially provided and within the limits of the possibilities provided by the chosen customization technique. Changes that differ from the graphics initially provided by the Customer, entail an additional charge for plant modification and / or further increases even to the individual items that involve such customization. The Customer will not be able to apply any changes, after the graphic draft has been approved, unless further charges are incurred. With the acceptance of the conditions of sale, the Customer acknowledges that the graphic previews and / or graphic drafts provide a "virtual reproduction" of the final creation. This reproduction could therefore not faithfully reflect the final result of the final product, in particular as regards the proportions between personalization and garment, colors and graphic elements. By accepting the conditions of sale and placing the order, the Customer acknowledges that the expense items of the system contribution are necessary costs for the realization of the customization. The payment of these expenses does not in any case involve the transfer of ownership or the physical transfer to the Customer, of files or other media created by d-kola for this purpose. d-kola reserves the right to use the graphics created and sent directly by the Customer, limited to the products created, for promotional or advertising purposes by any means of communication.
The goods supplied must be paid for as indicated in the table available in the Payments section. d-kola reserves, at its sole discretion, the right not to proceed with the shipment of the goods, even after accepting the order, to those customers who are out of credit, or with outstanding or in dispute.
13. Right to cancel orders
The customer may request the cancellation of the order and d-kola reserves the acceptance of the cancellation of the same. The cancellation and acceptance of the same must be in writing. The right to cancel the order is precluded to the customer in the event that the goods have been expressly ordered by d-kola from its supplier and the latter has not accepted, in turn, the cancellation of the order.
14. Returns of Goods
We guarantee that all the goods sold are authentic, new and comply with high quality controls according to what are the standards of the company. All products purchased on www.d-kola.com are protected by a Satisfied or Refunded guarantee which guarantees a full refund or replacement of the product if new and unused. If you are not satisfied with the purchase, you can make the return within 14 days of delivery for: Right of withdrawal: the entire sum paid will be refunded, excluding shipping and payment costs Defective product: the product will be replaced with a product identical.Change product specifications: the product will be replaced with another size / color / modelThe return of goods to d-kola must be requested in writing or through the appropriate section "Your returns" in the customer area registered on the website www. d-kola.com, indicating the reasons for the request, citing the order references and must be expressly authorized. The goods to be returned must be shipped prepaid to our warehouse in perfect condition, returned as new and unused, in its original box and with all related documentation (including warranty), parts and accessories to ensure a full refund. "New and unused" means that there must be no abrasions, marks or stains on the item; there must not even be signs that the product has been worn, the label must be present as well as the box; moreover it must not have been deformed or altered in any way. We cannot accept products that display any of the above indications. Goods returned without authorization will not be accepted.
15. Shipments received in damaged packaging
If there is extensive damage to the packaging, refuse the order and contact our customer service immediately. When contacting our customer service you need to have your order number available.

The purchase of material from d-kola implies full acceptance of the warranty conditions provided by the manufacturer, which may be independent of the will of d-kola itself. The customer, therefore, is aware that the purchased goods will be guaranteed by the manufacturer and under the conditions provided for by the same, and therefore accepts, with all reservations removed, all the methods of providing the manufacturer's warranty, also with reference, by way of example, of the manager of the guarantee also other than d-kola.
